Complaints & Disputes
The Uniquely Cook Islands program is built on trust and shared responsibility between businesses, makers, and the communities they represent. When issues arise, there is a clear and transparent process for raising concerns, reporting misuse, and resolving disputes.
This process helps protect accredited members, prevent misuse of the Mark and Tokens, and maintain public confidence in the program. It also ensures that cultural integrity, fairness, and respect guide every decision.
1. Purpose
The complaints and disputes process:
- Ensures issues are handled fairly and transparently.
- Protects accredited members who follow the rules.
- Addresses violations of the Uniquely Cook Islands Rules, Regulations and Requirements.
- Prevents misuse of the Mark and Tokens.
- Helps safeguard Cook Islands culture and uphold the reputation of Cook Islands businesses and creators.
2. Role of BTIB (Administrator)
BTIB manages the program day-to-day and is the first point of contact and triage for complaints and allegations of misuse of the Mark or Tokens. Its role is to:
- Receive complaints from consumers, members, and the public.
- Record all complaints and actions taken.
- Resolve routine matters directly with members, such as:
- Incorrect registry information.
- Misplaced or misformatted Tokens.
- Minor breaches or unintentional misuse of the Mark or Tokens that can be quickly corrected.
- Support members to correct mistakes, recognising that many issues are oversights rather than deliberate misuse.
- Where necessary, impose a temporary suspension while a matter is being investigated or corrected.
- Escalate serious or complex matters including repeated or deliberate misuse, or any matter that may require revocation to the Governance Panel for further consideration.
BTIB’s approach reflects the Cook Islands principle of resolving issues as close as possible to their source, with fairness, education, and restoration at the heart of the process.
3. Role of Convened Groups
When an issue is more serious, complex, or touches on cultural or community values, BTIB refers it to the Governance Panel. The Panel may convene one or more groups to ensure that the right expertise and voices are involved. These groups draw from a pool of experts and representatives to ensure cultural suitability and fairness based on the nature of the issue.
Disputes & Complaints Group
This group focuses on resolving formal disputes or serious complaints that cannot be settled through BTIB.
- Membership varies depending on the matter.
- May include Governance Panel members, sector representatives, and cultural experts.
- Reviews evidence, listens to perspectives, and reaches a collective, binding decision.
- Ensures that all outcomes are culturally appropriate, fair, and transparent.
Cultural Review Group
This group safeguards cultural integrity whenever a dispute or complaint involves traditional knowledge, cultural motifs, or practices.
- Draws on a pool of respected practitioners, elders, and knowledge holders representing key cultural disciplines within the Cook Islands.
- Provides cultural advice and expertise to ensure decisions honour Cook Islands culture and values.
4. Role of the Governance Panel
The Governance Panel provides independent oversight of the complaints and disputes system. It is a peer-governed body, made up of representatives from Rarotonga, the Pa Enua, and the Diaspora, as well as key industry and practice areas. The Panel ensures that decision-making remains transparent, accountable, and beneficial to the wider community. Refer to Governance & Oversight for more detail.
Its responsibilities include:
- Convening a Disputes & Complaints Group to hear a matter.
- Hearing a dispute directly if it has program-wide significance.
- Serving as the final venue for appeals in exceptional cases.
- Monitoring outcomes to ensure consistency, fairness, and accountability.
- Ensuring that all decisions reflect Cook Islands traditions of inclusion, respect, and collective responsibility.
5. Outcomes
Depending on the findings, outcomes may include:
- Correction – for minor matters or oversights.
- Suspension – temporary removal of membership or Tokens.
- Revocation – withdrawal of accreditation for serious or repeated breaches.
- Legal action – against individuals or businesses using the Mark or Tokens without authorisation.
6. Transparency and Reporting
- BTIB records all complaints and their resolution.
- Members’ public registry listings are updated when status changes.
- The Governance Panel publishes an annual summary of complaints and outcomes to maintain transparency and accountability.
